Welcome to Dear Future Me.
These Terms of Service ("Terms") govern your access to and use of the website and related services located at https://dearfutureme.com (the "Service"), operated by Yeh Solutions LLC, doing business as Dear Future Me ("Dear Future Me," "we," "our," or "us").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. The Service
Dear Future Me allows users to create personal messages that are scheduled for future delivery by email, physical mail, or both.
The Service is intended for lawful personal use. It is not intended to function as a permanent storage or archival service.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
By using the Service, you represent and warrant that:
- you have the legal capacity to enter into these Terms;
- the information you provide is accurate; and
- you will use the Service only for lawful purposes.
3. Email Verification
You must verify ownership of the email address you provide before scheduling a letter.
You may not provide another person's email address without authorization or attempt to bypass the verification process.
4. Payments
Certain delivery options require payment.
Payments are processed by an independent third-party payment processor.
Dear Future Me does not receive or store your complete payment card information.
Prices, applicable taxes, and any delivery fees are presented during checkout before payment is completed.
Payment is considered complete only after confirmation from the payment processor.
5. Physical Mail
Physical letters are mailed only to the verified recipient using the billing address provided during checkout.
Dear Future Me determines the mailing format, packaging, postage method, and return address.
Actual delivery dates may vary depending on postal services, printing providers, holidays, weather, and other circumstances outside our reasonable control.
6. Delivery
We will use commercially reasonable efforts to deliver letters on or after the selected delivery date.
However, we cannot guarantee:
- exact delivery dates;
- uninterrupted availability of the Service;
- delivery by third-party email providers;
- postal delivery times;
- delivery where incorrect or incomplete information has been provided; or
- delivery affected by circumstances beyond our reasonable control.
7. User Content
You retain ownership of the content you submit.
You grant Dear Future Me a limited, non-exclusive, worldwide, royalty-free license to store, process, reproduce, and transmit your content solely as necessary to operate and provide the Service.
This license automatically terminates once your content has been removed in accordance with our Data Retention Policy, except where continued retention is required by law.
8. Acceptable Use
You agree not to use the Service to:
- violate any applicable law or regulation;
- infringe another person's rights;
- impersonate another person;
- upload malicious software or harmful code;
- interfere with the operation or security of the Service;
- submit fraudulent payment information;
- distribute spam or unsolicited communications;
- upload content involving the sexual exploitation or abuse of children;
- upload unlawful, threatening, defamatory, harassing, hateful, or obscene material; or
- use the Service for any unlawful purpose.
We reserve the right to reject, suspend, remove, or report content that violates these Terms or applicable law.
9. Content Moderation
Uploaded content may be reviewed using automated moderation technologies to detect prohibited or unlawful material.
Where required by applicable law, Dear Future Me may preserve, restrict access to, or report unlawful content to the appropriate authorities.
10. Privacy
Your use of the Service is also governed by our Privacy Policy.
Our collection, use, retention, and protection of personal information are described in the Privacy Policy.
11. Intellectual Property
The Service, including its software, design, branding, trademarks, logos, graphics, text, and other content provided by Dear Future Me, is protected by intellectual property laws.
Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
12. Availability
We may modify, suspend, discontinue, or update any part of the Service at any time.
We are not liable for interruptions, maintenance, outages, or events beyond our reasonable control.
13. Refunds
Refunds are provided in accordance with our Refund Policy and applicable law.
Once a physical letter has entered production or has been mailed, refunds may no longer be available except where required by applicable law.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
DEAR FUTURE ME DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM HARMFUL COMPONENTS.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEAR FUTURE ME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC LETTER GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS LIMITS LIABILITY WHERE SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.
16. Indemnification
You agree to indemnify, defend, and hold harmless Dear Future Me, its officers, directors, employees, contractors, and affiliates from any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
- your use of the Service;
- your violation of these Terms;
- your violation of applicable law; or
- your infringement of another person's rights.
17. Termination
We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, applicable law, or the security or integrity of the Service.
Termination does not affect provisions that by their nature survive termination, including payment obligations, intellectual property rights, limitations of liability, indemnification, legal holds, dispute resolution, and other provisions intended to survive.
18. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Any legal action arising from or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in California, unless applicable law requires otherwise.
19. Changes to These Terms
We may update these Terms from time to time.
When material changes are made, we will update the Effective Date at the top of this page.
Continued use of the Service after the revised Terms become effective constitutes acceptance of the updated Terms.
